Rik Farrow, a security expert showed that an iPhone with a ROM older than 1.1.2 could be hacked to allow an intruder to tune in text messages, emails or conversations. The hacker does not even need to have physical access to the phone because the code can be simply uploaded via email or http by usual phishing techniques. iPhones with the 1.1.2 updates should be OK as the loophole has been closed.
