Unknown to some, Apple previously filed a complaint to the ITC on Monday against the Taiwanese mobile manufacturer HTC for allegedly infringing its “data tapping” patent. According to Apple, in spite of HTC’s claims that it has worked around the data tapping patent, HTC still infringes the patent.
Foss Patents reported that Apple asked the ITC for an emergency proceeding and enforcement action to prevent further infringement, targeting 29 HTC devices along the process, including the HTC One X, One S, and One V. But today, Thursday, HTC has responded to Apple’s allegation saying that its new models are in compliance with the International Trade Commission’s ruling.
“The U.S. Customs office has reviewed and approved HTC devices for import into the U.S., as they are in compliance with the ITC’s ruling,” HTC said in a statement. It sounds like HTC was able to work its way around Apple’s accusation. It’s important to note that both parties have been duelling for years. Apple filed its first ITC complaint against HTC in 2010 – widely known as the first ever lawsuit against an Android device manufacturer.
