For those who have been following the patent wars, you might recall that sometime last year, HTC “borrowed” some of Google’s patents which they were hoping would bolster their offense against Apple. While that sounded like a great plan, Apple moved ahead and filed a motion that would prevent HTC from using said patents. Well now it looks like in the whole Apple vs HTC war, it seems that Apple will be able to chalk up yet another victory. Administrative Law Judge Thomas Pender has officially granted Apple that motion and ruled that HTC cannot use their “borrowed” patents since they have failed to acquire the proper rights. Safe to say HTC will be appealing this decision, although if their appeal is also overturned, this pretty much leaves three out of eight patents they can use against Apple with regards to the ITC dispute.
