a123Back in February amidst the rumors that Apple is looking to build an electric car of their own, the Cupertino company was hit with an employee poaching lawsuit by A123 Systems. However it seems that Apple does not think that the lawsuit has any merits and has since filed a motion to dismiss it, claiming that it failed to meet certain legal requirements.

According to the motion to dismiss, Apple claims that the complaint “fails to state a claim upon which relief may be granted.” Basically it means that A123 failed to meet the minimum requirements needed in order to file for a lawsuit, thus making it not valid. It remains to be seen if it will be dismissed, but for now that is Apple’s response to it.

For those hearing about this for the first time, A123 filed a lawsuit against Apple last month claiming that they had poached five key employees from their company. While employees can always been replaced, A123 felt that these employees were important enough where they were unable to find suitable replacements for them.

This was amidst the rumors that Apple was looking to build an electric car and interestingly enough, A123 Systems is a company that works on batteries and energy solutions whose products and technology have found their way into electric vehicles as well.
