Revenge porn, the act of sharing someone’s intimate photos or videos online without consent, is now officially a crime in New York City. It was back in November last year when the New York City Council voted unanimously to criminalize revenge porn and the law is now being enforced. It’s now a misdemeanor offense in the city to post revenge porn with perpetrators looking at fines of $1,000 and up to one year in jail.

Revenge porn has also been criminalized by some states in the country. New Jersey was the first and it actually classifies revenge porn as a felony. California was the second to criminalize it, the state classifies revenge porn as a criminal misdemeanor with penalties of up to six months in jail and a $1,000 fine.

Josh Levitt, communications director for Councilman Rory Lancman, has confirmed that revenge porn is officially a crime in New York City now. He also explained that even if the victim isn’t in the city but the perpetrator is, then the courts will have jurisdiction over the matter. If it’s the other way around then it’s a jurisdictional issue that the courts will have to work out.”

The law isn’t retroactive meaning that those who have distributed intimate photos or videos of someone online before this law went into force won’t be held accountable but those who do this now will be committing a crime.
