iPhone 5 Added To List Of Patent Infringing Devices

The legal battle between Samsung and Apple continues, as it seems that the list of infringing devices has been lengthened yet again with the inclusion of the iPhone 5, Samsung Galaxy Note and Samsung Galaxy S3. U.S. Magistrate Judge Paul Grewal in San Jose, California, ruled that Samsung could throw in the iPhone 5 to its current complaint for a second landmark smartphone patent trial that is tipped to begin soon, and in a parallel ruling, Apple would be able to assert its patents in the same trial against the Samsung Galaxy Note, Galaxy S3, as well as Samsung’s interpretation and installation of the Android 4.1 Jelly Bean operating system.

In his Thursday ruling, Judge Paul Grewal did mention that Samsung had acted with “reasonable diligence” when requesting the permission of the court to add the iPhone 5 from Apple. Other devices that folks speculate could be added to the lawsuit by Samsung include the recently released iPad 4 (or refreshed iPad 3, depending on how you want to call it) and iPad mini. The good Judge Paul Grewal also warned Apple to “think twice before opposing similar amendments reflecting other newly released products”, although Apple has yet to oppose the addition of the iPhone 5 to the suit.
