As you can see in the image above, a trio of firefighters raised the American flag over the site of World Trade Center, and this is right after the two buildings were destroyed in a terrorist attack on September 11, 2001. Franklin captured this image as an employee of The Bergen Record, which would have meant that the photograph was a work for hire, and the copyright owner happens to be North Jersey Media Group (NJMG), who in turn owns The Bergen Record.
Court papers pointed out that licensing of the photograph peaked between 2002 and 2004, but that does not mean that there has been no more licensing since then. This just goes to show how you can never discount the value of snapping an impromptu photo of a ground-shattering event.
