Apple and Samsung have fought a very long legal battle over patent infringement, the first jury trial took place in 2012 and found Samsung to be guilty of patent infringement, the Korean company was slapped with $1.05 billion in damages but it went through a long process or retrials and appeals to cut the award down to $548 million. As the second damages retrial looms on the horizon the two companies have once again agreed to mediate the dispute in hopes of reaching an amicable settlement.

This isn’t the first time that both companies have agreed to be part of court supervised mediation, they did so back in 2012 and even before the second jury trial began in 2014 but both times there was no agreement on the underlying issue.

Lawyers for Apple and Samsung have filed a joined alternative dispute resolution statement with the U.S. District Court for the Northern District of California, telling the court that they have agreed to enter court supervised mediation which will be presided by Magistrate Judge Joseph Spero this November.

There mere act of sitting across a table from each other and trying to talk things out won’t immediately have an effect on the second damages trial which is expected to take place either in March or April in the coming year.
