When Fortnite’s dances were revealed, there were many who pointed out how a lot of them looked like familiar dance moves, moves that had gone viral. However in the past month, it seems that some of the creators of those dances weren’t too happy that Epic was profiting off them.

Rapper 2 Milly and actor Alfonso Ribeiro have recently filed lawsuits against Epic for using their dance moves without permission, and it now looks like we have another celebrity to add to that list. Russell Horning, also known as Backpack Kid whose dance moving “Flossing” went viral after Horning posted a video of himself performing the move on Instagram.

As with the case with the other dance moves in Fortnite, Epic did not try to hide the fact that the move in the game was inspired by Horning’s move as they named it “The Floss”. That being said, dance moves are difficult to copyright so we’re not sure how this could be argued in a court of law, although in Horning’s case he had apparently filed for the patent.

Also we’re not sure if Horning’s earlier statements might come back and work against him. In an event earlier this year, TMZ caught up with Horning where when he was asked about his dance being used in Fortnite, he replied by saying, “It’s not that big of a deal, I’m just glad it’s in the game.”
