According to the lawsuit, it alleges that all Apple Watches from Series 0 up to Series 3 are defective where, “The Watches all contain the same defect and/or flaw, which causes the screens on the Watches to crack, shatter, or detach from the body of the Watch (the ‘Defect’), through no fault of the wearer, oftentimes only days or weeks after purchase.”
The lawsuit also goes on to allege that Apple apparently knew about these “defects” ahead of time but went ahead and sold them to the public anyway, and that they “actively concealed” and “fail to disclose” these defects to the public at or after the time of purchase. It also claims that Apple has an internal policy which is to deny the existence of the alleged defect, claiming that any damage is caused by the customer which then allows them to refuse to honor its Limited Warranty.
While there have been some instances of defects, such as swollen batteries and stripes appearing on the Apple Watch’s display, they have been addressed by Apple who has either offered extended warranties or replacements. The lawsuit is seeking damages of $5 million but Apple has yet to respond to it.
